1. INTRODUCTION OSCARDİA İLAÇ KOZMETİK TIBBİ CİHAZLAR GIDA TARIM ÜRETİM İTHALAT İHRACAT PAZARLAMA SANAYİ VE TİCARET A.Ş. (hereinafter referred to as “OSCARDIA”), located at Kavacık Mah. Elbistan Sk. Pekiz Plaza No:5/8 Beykoz/İstanbul, attaches utmost importance to the security of your personal data. Your personal data is processed and stored by us in accordance with the Law on Protection of Personal Data No. 6698 (“KVKK”). By using or visiting the website with the extension www.appthecleaner.com (“Website”) and mobile applications that may be put into use in the future (“Mobile Application”), and without being limited to these, any online platform or physical space under OSCARDIA’s control (all hereinafter referred to as “Platform”), you confirm that you have read, understood, and accepted the terms specified in this Privacy Policy (“Policy”). In case of any changes to the Policy, the Policy will be published on our Website in its current form, with the date of change indicated. We will inform you about this change for 30 (thirty) days following the change through a reasonable and noticeable link on the Website.

2. INFORMATION AS DATA CONTROLLER As OSCARDIA, in accordance with the Law on Protection of Personal Data No. 6698 (“KVKK”) and within the framework of current legislation, your personal data will be recorded, stored, updated, disclosed to third parties when permitted by law, transferred, categorized, and processed using methods compliant with the terms and conditions listed in KVKK, as explained on this page, acting as the data controller.

3. HOW PERSONAL DATA MAY BE PROCESSED Your personal data shared with OSCARDIA may be processed by us, fully or partially, automatically or by non-automatic means provided that it is part of a data recording system, by obtaining, recording, storing, modifying, reorganizing, in short, by subjecting it to any operation performed on data. Any operation performed on data within the scope of KVKK is considered “processing of personal data”.

4. PERSONAL DATA THAT MAY BE PROCESSED OSCARDIA collects certain data, such as personal data entered by the relevant person for the purposes of becoming a member of any OSCARDIA Platform, performing transactions through these platforms, participating in events, obtaining information, becoming a member or participating in Platforms, participating in contests and events, any purchase, service provision, receiving newsletters, participating in events, data related to your participation in all of these, and data obtained from third-party platforms you connect with OSCARDIA. In addition, some data is collected automatically, such as information about your device and which parts of the Platform you interact with or spend time using.

Below are some examples to help you better understand the data we collect:

Account Data: To use certain features (such as purchasing products and services, creating a user account, participating in activities, benefiting from services on Platforms), you may need to create a registration. When you create or update a registration, we collect and store data such as your name, surname, Turkish ID number, email address, password, gender, date of birth, phone number, and residential address.

Shared Content: You are enabled to interact with others and publicly share content, including posting comments on an OSCARDIA social media or internet page, asking or answering questions, sending messages to OSCARDIA accounts, OSCARDIA managers or employees, or OSCARDIA supporters, sponsors, organizers, business partners, or publishing photos or other works you upload. Such shared content may be publicly viewed by others depending on where it is published.

User and Visitor Data: When you register for or participate in Platforms or any OSCARDIA activity, we collect certain data, including information about the opportunities you will benefit from; your interactions with OSCARDIA and other items submitted to meet your needs regarding the services OSCARDIA will offer.

Payment Data: We collect data related to payments you have made within the Platforms (your name-surname, information about the payment service you used for payment, your address). You must directly provide certain payment and billing data such as your name-surname, Turkish ID number, credit card information, billing address, and postal code to our payment processing partners. For security reasons, OSCARDIA does not collect or store sensitive cardholder data such as full credit card numbers or card authentication data.

Business Partner Data: If you are an OSCARDIA employee, consultant, business partner, sponsor, supplier, distributor, or reseller, OSCARDIA collects or stores your personal data related to your payment account for security reasons, including sensitive bank account information. The collection, use, and disclosure of your payment and billing information are subject to this Policy and the other terms of your payment account provider.

Data About Your Other Accounts: If your user accounts for OSCARDIA Platforms are linked to another account, we may obtain certain information from your social media or other online accounts. If you log in to the Platforms through Facebook or another third-party platform or service, we will ask for your permission to access certain information related to that other account. For example, depending on the platform or service, we may collect your name, profile picture, account ID number, login email address, location, physical location of your access devices, gender, birthday, and friend or contact list. These platforms and services provide us with information via their APIs. The information we receive depends on what you (through your privacy settings) or the platform or service decide to give us.

Sweepstakes, Promotions, and Surveys: We may invite you to complete a survey or participate in a promotion (such as a sweepstakes or contest) through opportunities on the Platforms or through a third-party platform. If you participate, we collect and store the data you provide as part of your participation, such as your name, surname, Turkish ID number, address, email address, date of birth, or phone number. Unless otherwise stated in the official rules of the promotion or another privacy policy, this data is subject to the terms of this Policy. The collected data will be used to administer the promotion or survey, including notifying winners and distributing prizes. To win a prize, you may need to allow us to publicly publish some of your information (e.g., on a winners page). When we use a third-party platform to administer a survey or promotion, the third party's privacy policy applies.

Communication and Support: If you contact us for support or to report a problem or concern (whether or not you have created an account), we collect and store contact information, messages, and other data about you such as your name, email address, location, operating system, IP address, and all other information you provide and that we collect through automated methods (as detailed below). We use this data to respond to you in accordance with the Policy and to answer your question or investigate and address your concern.

5. PURPOSES OF PROCESSING PERSONAL DATA Your shared personal data will be processed in accordance with KVKK and secondary regulations, for the following purposes:

• To fulfill the services we provide to you and to facilitate the provision of services related to the activities we carry out with our business partners;

• To communicate with you and manage our awareness and promotional activities;

• To provide information to prosecutor's offices, courts, and relevant public officials in matters related to public safety and legal disputes, upon request and as required by law;

• To offer you a wide range of opportunities or to share these opportunities with individuals or institutions within the legal framework.

 

6. METHOD OF COLLECTING PERSONAL DATA Your personal data is collected through:

• Forms on the website, mobile applications, or other Platforms, including your name, surname, Turkish ID number, email address, password, gender, date of birth, phone number, residential address; preferences on pages accessed using a username and password, IP records of performed transactions, cookie data collected by the browser including Browse time and details, and location data.

• Through our channels such as event and consultation activities, paper forms, business cards, and digital environments, verbally, in writing, or electronically.

• From individuals who share their personal data for purposes such as establishing a relationship with OSCARDIA, applying for a user account on OSCARDIA platforms, applying for a job, submitting an offer, through business cards, resumes (CVs), submitting offers, and other means, in a physical or virtual environment, face-to-face or remotely, verbally or in writing or electronically.

• Additionally, data obtained indirectly from different channels, such as (micro) websites used for websites, blogs, contests, surveys, games, campaigns, and similar purposes, and from social media, e-newsletter reading or clicking actions, data provided by publicly available databases, and publicly shared profiles and data from social media platforms (Facebook, Twitter, Google, Instagram, Snapchat, etc.) can be processed and collected.

 

7. TRANSFER OF PERSONAL DATA OSCARDIA may transfer your personal data within the framework of personal data processing conditions and purposes specified in Articles 8 and 9 of KVKK, in order to: provide fully and timely opportunities and benefits within the legal framework in line with the purposes and fields of activity specified in this Policy; inform OSCARDIA Platform users about the opportunities provided specifically and limitedly to users; appropriately fulfill the requirements of the services provided to members, non-member beneficiaries, and other stakeholders; develop the services offered and activities carried out, IN SHORT, to benefit the individuals using the Platforms; fulfill the obligation to record identity, address, and other necessary information for identifying the transaction owner; comply with information storage, reporting, and notification obligations mandated by legislation and other authorities; provide information to all official institutions, especially judicial authorities, and relevant public officials in matters related to public safety and legal disputes, upon request and as required by legislation; and to offer users a wide range of opportunities or share these opportunities with individuals or institutions within the legal framework.

In this context, your Personal Data may be transferred to:

• Our business partners and/or supplier companies with whom we collaborate for the provision and promotion of services and the development of activities, as well as banks, financial institutions, TBB Risk Center, and other real or legal persons.

• Authorized authorities that will determine our location in case of an emergency call.

• Lawyers, auditors, consultants, and other third parties from whom services are received.

• Your authorized proxies and representatives.

• Regulatory and supervisory institutions, and other official institutions such as courts and enforcement offices, other public institutions or organizations authorized to request your personal data.

• Legal entities that have a relationship with the Company in any way and possess your phone number.

• Banks and similar financial institutions for ensuring transaction and information security and for identity verification during banking and similar financial transactions you perform via your mobile lines, information such as SIM card change, phone number you are connected to mobile internet.

• Business partners, sponsors, and organizers who carry out events and organizations.

 

Your personal data, collected by any of the methods listed above, may also be transferred to service intermediaries located abroad (to countries accredited by the Personal Data Protection Board and where sufficient protection for personal data exists) to be processed in Turkey or processed and stored outside Turkey, provided that it remains within the scope of KVKK and is in accordance with the contractual purposes.

 

8. STORAGE AND PROTECTION OF PERSONAL DATA OSCARDIA takes appropriate and reasonable technical and organizational measures to prevent the loss, misuse, or alteration of your personal data.

OSCARDIA is obliged to prevent unlawful processing of personal data, to prevent unauthorized access, and to take necessary measures to ensure their protection, in accordance with Article 12 of KVKK, regarding the systems and databases where your personal data is stored.

Since data transfer over the internet may be considered insecure by its nature, despite all reasonable precautions taken by our Company, the security of data sent over the internet cannot be guaranteed. However, OSCARDIA will provide all necessary technical and organizational measures under normal conditions to ensure the security of this data.

If it is learned that personal data has been obtained by others through illegal means, the situation will be immediately reported to the Personal Data Protection Board in accordance with legal regulations and in writing.

 

9. ACCURACY OF PERSONAL DATA In accordance with Article 4 of KVKK, OSCARDIA has an obligation to keep your personal data accurate and up-to-date. In this context, in order for OSCARDIA to fulfill its obligations arising from the current legislation, those who share their personal data with us must share accurate and up-to-date data or update it in a timely manner via the Platform used.

OSCARDIA may temporarily or permanently suspend the processes by which users benefit from the advantages and opportunities within the Platforms regarding unverified and/or unupdated personal data.

 

10. RIGHTS OF THE PERSONAL DATA OWNER In accordance with Article 11 of KVKK, your rights as a personal data owner from this date onwards are as follows:

a) To learn whether your personal data is being processed; if it has been processed, to request information regarding this. b) To learn the purpose of processing your personal data and whether it is used in accordance with its purpose. c) To know the third parties to whom your personal data is transferred domestically or abroad. d) To request correction of your personal data if it is incomplete or incorrectly processed. e) To request the deletion or destruction of your personal data within the framework of the conditions stipulated in Article 7 of KVKK. f) To request notification of the operations carried out in accordance with paragraphs (d) and (e) above to third parties to whom your personal data has been transferred. g) To object to the occurrence of a result against you due to the exclusive analysis of your personal data by automatic systems. h) To demand compensation for damages if you suffer damage due to unlawful processing of your personal data in violation of KVKK.

 

11. APPLICATION OSCARDIA is the data controller under KVKK. The appointed data controller representative will be announced on the Platform where this document is located when the legal infrastructure is provided. Personal data owners can send their questions, opinions, or requests via email to info@oscardia.com or by post or hand delivery to the authorized OSCARDIA representative at Kavacık Mah. Elbistan Sk. Pekiz Plaza No:5/8 Beykoz/İstanbul.

Requests must be made using the Application Form available at www.appthecleaner.com OSCARDIA may respond positively/negatively to requests within 30 (thirty) days, in writing or digitally, provided that the response is justified. Necessary actions regarding requests are essentially free of charge. However, if the operations require a cost, OSCARDIA reserves the right to charge a fee. These fees are determined by the Personal Data Protection Board based on the tariff specified in Article

13 of the Personal Data Protection Law.

By sharing your personal data on the Website, Mobile Applications, and other Platforms, you hereby confirm that you accept the terms regarding processing, processing methods, data transfer, sale, and other related matters contained herein; that you will apply to OSCARDIA before exercising your legal rights; and that you give explicit consent, defined in KVKK as "a specific, informed, and freely given consent to a particular matter of great importance."
